1. Acceptance of Terms

By accessing and using LuminoDrive's lead generation platform and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

LuminoDrive provides lead generation and social advertising automation services. Our platform helps businesses discover, qualify, and engage potential customers through various advertising channels and social networks. Services include lead discovery, qualification, campaign management, and performance analytics.

3. Pricing and Payment Terms

LuminoDrive operates on a per-qualified-lead pricing model with rates varying by advertising channel:

  • Standard Channel: $40 per qualified lead
  • Premium Channel: $50 per qualified lead
  • Enterprise Channel: $60 per qualified lead

Payment is due upon delivery of qualified leads. Leads that do not meet agreed-upon qualification criteria will not be charged. All pricing is subject to change with 30 days written notice.

4. Lead Quality and Qualification

LuminoDrive guarantees that all leads meet the qualification criteria established during the initial consultation and setup process. Qualification criteria may include demographic information, company size, industry, geographic location, and behavioral indicators. Clients will only be charged for leads that meet these pre-agreed specifications.

5. Data Usage and Compliance

All lead generation activities comply with applicable data protection laws including GDPR, CCPA, and CAN-SPAM Act. LuminoDrive maintains appropriate data security measures and only uses data sources that have proper consent and legal basis for marketing communications.

6. Client Responsibilities

Clients are responsible for:

  • Providing accurate target customer profiles and qualification criteria
  • Maintaining active and properly configured social media accounts
  • Responding to qualified leads in a timely manner
  • Complying with all applicable laws and regulations in their marketing activities
  • Providing feedback on lead quality to help optimize campaigns

7. Service Availability

LuminoDrive strives to maintain 99.9% uptime for our platform. Scheduled maintenance will be announced in advance. We are not liable for service interruptions due to circumstances beyond our control, including but not limited to natural disasters, internet outages, or third-party service failures.

8. Intellectual Property

All content, features, and functionality of the LuminoDrive platform are owned by LuminoDrive and are protected by copyright, trademark, and other intellectual property laws. Clients may not reproduce, distribute, or create derivative works without express written permission.

9. Limitation of Liability

LuminoDrive's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, special, or consequential damages. While we guarantee lead quality, we cannot guarantee conversion rates or sales outcomes, as these depend on factors outside our control.

10. Termination

Either party may terminate services with 30 days written notice. Upon termination, clients remain responsible for payment of all qualified leads delivered prior to termination. LuminoDrive will provide final reporting and assist with data export as needed.

11. Modifications to Terms

LuminoDrive reserves the right to modify these terms at any time. Significant changes will be communicated via email with 30 days notice. Continued use of services after modifications constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
